TOYOTA CITY, 31 AUG 2026 — Toyota will put a new driving system into passenger cars from 2028, reported as near fully autonomous, letting drivers take their hands off the wheel on ordinary roads. It is Level 2. The driver remains legally responsible for everything the car does.

What was announced

Toyota said on 28 August that it will develop its own Level 2++ system for passenger vehicles from 2028, expanding across more models from 2030. Drivers will be able to take their hands off the wheel on general roads, and the system will use AI to handle more of the driving and reduce how often a human has to intervene.

Separately, Toyota is targeting Level 4 autonomy for commercial vehicles by the end of the decade. Those are two different programmes with two different legal statuses, and only the second one is autonomy.

The plus signs are not a level

SAE J3016 defines six levels from 0 to 5. Level 2++ is not among them. It is an industry coinage for a driver-assistance system at the capable end of Level 2, and the extra characters carry no regulatory or legal meaning at all.

Level 2 is defined by who is driving, not by how much the car does. At Level 2 the human is the driver, must monitor the road continuously, and is responsible for the outcome, no matter how long their hands are off the wheel or how well the system performs. A system that steers, brakes, accelerates and changes lanes on a motorway for an hour is still Level 2 if the human is expected to be watching.

Level 3 is where that changes. At Level 3 the system is the driver within its operating conditions, the human may stop monitoring, and liability shifts to the manufacturer for the period the system is engaged. This transfer of liability is the entire substance of the distinction. It is why Level 3 approvals have been slow and narrow while Level 2 systems have proliferated.

Hands-off is a poor proxy for anything

The detail carried in every headline is that drivers can take their hands off the wheel on general roads, and it is the least informative fact in the announcement.

Hands-off capability is a comfort and packaging decision, governed by whether the system uses a driver monitoring camera to confirm attention instead of torque sensors in the wheel. Several manufacturers already ship hands-off Level 2 on divided highways. Extending it to general roads is a meaningful engineering step, and it changes nothing about who is liable.

This confusion is a known safety problem. A system that requires no physical input but full mental attention is the hardest possible thing for a person to comply with, because sustained vigilance with nothing to do is something humans are measurably bad at. That is not a comment on careless drivers; it is the well-documented reason Level 3 exists as a category.

Why Level 4 goes to commercial vehicles first

Toyota's plan to put Level 4 in commercial vehicles and Level 2 in passenger cars is a coherent strategy that shows where the real difficulty lies.

Commercial vehicles run defined routes, on schedules, under a fleet operator who can restrict the operating domain, train staff and accept liability commercially. That is a bounded problem. A privately owned passenger car goes wherever its owner points it, in any weather, with an untrained driver, and the manufacturer would be accepting liability for all of it.

What sets the sequence is the operating domain and who holds the liability, and the software is the same either way. It is the same logic that put autonomy into mines before public roads, and it is the reason a Level 4 commercial launch in 2030 does not imply a Level 4 passenger car soon after.

What this means for buyers in this region

Two practical points, and the first has money attached.

Insurance and liability in Malaysia, Thailand, Indonesia and the Philippines are written on the assumption that a human is driving. A Level 2 system, however capable, keeps that assumption intact. A driver whose car steers itself into a collision is in the same legal position as one who was holding the wheel. Nothing about the 2028 system changes an insurance claim.

The second is about conditions. Systems of this class are validated on lane markings, predictable traffic and legible road geometry. Regional driving offers motorcycles filtering at speed, unmarked lanes, informal stops and roadworks without signage — and a system tuned to be cautious in ambiguity will disengage or brake more often here. We reported that the only robotaxi injuries anyone has counted came from hard braking with no obstacle present, and that behaviour is a property of the whole class, not of one operator.

What would be worth reporting

Three things, none of which is in the announcement.

The operational design domain — which roads, which weather, which speeds — will determine whether hands-off on general roads means most of a journey or only a fraction.

The driver monitoring method, because a system permitting hands-off while requiring attention is only as safe as its ability to confirm the attention is there.

And whether Toyota intends a Level 3 passenger product at all. New Jersey's bill requiring a camera plus two further sensing modalities shows regulators legislating for the autonomous case. A manufacturer committing to Level 2 for passenger cars through 2030 is making a statement about liability. It is the most substantive part of the announcement.
